2017 Brings Piccuta Law Group Several New and Challenging Cases
2017 is off to a quick start and with it several new and challenging cases have been taken on by the Piccuta Law Group. These cases and clients are located throughout California and Arizona. These matters involve maritime claims, contract disputes, copyright infringement claims and motor vehicle accidents cases.
The first matter is a water system dispute involving four landowners in Monterey County, California. The dispute involves the replacement of an existing water system and the rights and responsibilities of those individuals with respect to implementing the new system. The matter is pending in the Monterey County Superior Court and involves water rights and contract claims. The Piccuta Law Group is defending its landowner clients and has also counter-sued to enforce the terms of a previous agreement.
The next matter involves an injury that occurred on a Princess Cruise Line. The firm’s client was swimming in the cruise ship pool at night when she was injured. The client was performing the butterfly stroke and landed on the concrete pool edge fracturing her nose. The pool had an overflow area which allowed the water from the pool to spill over onto the concrete decking. As such, it created a dangerous condition and the appearance that the water in the pool, and the pool itself, extended further than it actually did.
The third matter involves a sport-fishing charter out of Ventura, California. During the fishing excursion, one of the customers was reeling in a line that had become stuck in seaweed or kelp. Tension was on the line while it was being reeled in. While under tension, the line broke and a metal weight from the line shot like a projectile back toward the boat. The metal weight struck the firm’s client in the eye and exploded his orbit. The firm’s client lost sight in the injured eye. The injury was caused due to the negligence of the customer who was reeling in the line as well as the Sport-fishing charter who inadequately staffed the charter, failed to instruct the customers properly and failed to intervene to stop the dangerous situation.
The firm is also involved in representing a client who was accused of infringing a copyright. Specifically, the client was accused of misappropriating the artwork of another by using it on his wine labels. The artist claimed that this was an infringement of the copyright that arose upon creation of his work. The client has proof that he had permission to use the copyright. The matter remains contentious and unresolved.
The firm is also handling several new motor vehicle accident cases in both Arizona and California. One of the new cases involves a motorcycle-vehicle collision that occurred in Monterey County, California. The client was a passenger on a motorcycle that was passing vehicles in traffic on the shoulder of the road by the Whole Enchilada restaurant in Moss Landing, California. A vehicle turned and the motorcycle came into contact with it. The client suffered multiple injuries including a broken foot. The case is especially interesting to the Piccuta Law Group, because our firm is currently handling another motorcycle-vehicle case that occurred in the same stretch of road with similar facts.
