Ninth Circuit Appeal Filed By the Piccuta Law Group Scheduled for Oral Argument
On December 6, 2016, the United States Court of Appeals for the Ninth Circuit scheduled oral argument for an appeal filed by the Piccuta Law Group. The Appeal was filed in the matter of Todd and Maria Sharp v. Nationstar Mortgage, LLC and is 9th Circuit Appellate Case # 15-15066. Charles “Tony” Piccuta authored the opening appellate brief which was filed on May 26, 2015.
Piccuta filed the appeal on behalf of two homeowners who were wrongfully foreclosed on after the bank failed to give them the loan modification they were promised. The homeowners were represented by a different law firm who filed a lawsuit for the wrongful foreclosure. However, the lawsuit was eventually dismissed on a technicality because of something that occurred in a prior bankruptcy. When the other law firm was unwilling to step up to the plate and deal with the complex appeal, the homeowners reached out to the Piccuta Law Group. The Piccuta Law Group gladly accepted the challenge.
The Piccuta Law Group filed the appeal arguing that the dismissal of the homeowners’ lawsuit was wrong and that the lower court misapplied the law.
