Piccuta Law Group Files Excessive Force Civil Rights Lawsuit Against City of Stockton Police Officers
On June 1, 2017, the Piccuta Law Group filed a new civil rights’ lawsuit accusing Stockton Police Officers of unlawful search and seizure, wrongful arrest and excessive force during a routine traffic stop. The civil rights’ lawsuit was filed in the United States District Court for the Eastern District of California. The lawsuit is entitled Trinidad Brown v. Eddie Diaz, Et Al. and is case # 2:17-CV-01157. The lawsuit alleges violations of the client’s constitutional rights including the 4th and 14th Amendments.
The lawsuit alleges that the firm’s client was pulled over by Stockton Police for allegedly making an “unsafe” lane change. The lawsuit claims that the officers that pulled over the client, asked for his license and said that they would let him go without a citation if his background check came back clean. However, while the client was waiting for the officers to run his identification, a second patrol unit arrived. An officer from the second patrol unit, without speaking to the other officers, approached the client’s vehicle with his firearm drawn and stuck it through the window at the client’s head telling him he was under arrest and to exit the vehicle.
The lawsuit alleges that the client, who is African American, refused to do so until the officer withdrew his firearm. After which, the client refused to get out of the vehicle in fear for his safety. The officer then tased the client and he was removed from the vehicle and taken into police custody. The client, who is an employee of CalTrans, was charged with resisting arrest. A jury found him not guilty of those charges.
