Charles Tony Piccuta Presents Oral Argument in the Ninth Circuit Court of Appeals
On February 13, 2017, Charles Tony Piccuta presented oral argument to the Ninth Circuit Court of Appeals in San Francisco in the Matter of Todd Sharp v. Nationstar Mortgage, LLC (15-15066). The Ninth Circuit Court of Appeals hears appeals from the Federal District Courts located in California and other western states. The only other higher appeals court in the country is the United States Supreme Court.
Piccuta argued the matter on behalf of his homeowner clients who were wrongfully foreclosed on after they were promised a loan modification. At the lower court level, the court dismissed their wrongful foreclosure lawsuit. In doing so the lower court held that since the clients failed to list their wrongful foreclosure claims in their bankruptcy paperwork, they had lost their right to pursue those claims. Piccuta challenged whether this was appropriate and argued that the cases used by the lower court to do so were not properly applied. Piccuta also argued that the Ninth Circuit needed to establish a clear rule as to whether or not the lower courts could do this.
