Attorneys at Piccuta Law Group Settle Monterey Bus Accident Injury Case
Last week, our Monterey personal injury attorneys settled a bus accident injury case for over $45,000. The case involved the firm’s client who was a passenger on a Monterey Salinas Transit bus. As the bus was proceeding through an intersection on Lighthouse Avenue in Monterey, a vehicle failed to stop and struck the side of the bus. The impact caused the firm’s client to fall to the floor of the bus where she sustained a hairline fracture of her elbow and right wrist injury.
The client treated for both her elbow and wrist injury and made a full recovery. The client was able to return to her normal work duties within a few months and without permanent limitations. In addition, the client did not miss a significant amount of time from work recovering from her injuries. As a result, the settlement reached was based upon the pain and suffering she experienced in the few months she recovered from her injuries.
Generally, in a standard personal injury car accident case, the biggest factors determining the settlement amount are: 1) the extent of the injury; 2) amount of medical treatment/medical expenses; 3) permanency of the injury; and 4) affect of injury on someone’s daily living activities. Here, the client had an objective injury that could be proven. However, the client did not have significant medical expenses since she was a Medi-Cal recipient. Likewise, the client’s injury was not debilitating and did not affect her activities of daily living for a significant period of time.
Overall, based upon the above factors, the settlement reached was a terrific result. The client was very satisfied and pleased. The client sent our Monterey personal injury attorneys a handwritten note thanking them for the work they did and the result achieved. The client told the firm she was going to buy a new car with the proceeds so she will never be injured on a bus again!
